Terms of Service

1. Eligibility

You must be at least 18 years of age to create an account or use the Service, regardless of the age of majority in your jurisdiction. By using Kindova, you represent and warrant that:

• You are at least 18 years old.
• You are legally permitted to use online dating services under applicable law.
• You are not prohibited from using the Service by any court order or legal restriction.
• You are not required to register as a sex offender in any jurisdiction.

We reserve the right to request proof of age or identity at any time. Failure to provide satisfactory verification may result in suspension or permanent termination of your account.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information and to keep your profile updated.

Only one personal account is permitted per individual. You may not create additional accounts to circumvent restrictions, evade enforcement actions, or impersonate another person.

If you believe your account has been accessed without authorization, you must notify us immediately at support@kindovatech.com. You may review and sign out active sessions through Settings → Active Sessions.

3. Acceptable Use

You agree to use Kindova only for its intended purpose of meeting and interacting with other users in a lawful, respectful, and safe manner. Your use of the Service must comply with these Terms and our Community Guidelines, which are incorporated by reference.

You agree that you will not:

• Use automated tools, bots, scrapers, crawlers, or data-mining software.
• Reverse engineer, decompile, modify, or attempt to discover the source code of the Service.
• Disrupt, interfere with, overload, or compromise the security of the Service.
• Create fake accounts or impersonate another individual.
• Harass, threaten, stalk, exploit, or abuse other users.
• Upload illegal, defamatory, hateful, sexually exploitative, or otherwise prohibited content.
• Use the Service for fraud, scams, advertising, solicitation, or any unlawful purpose.
• Circumvent any suspension, restriction, or permanent ban imposed by Kindova.

4. Content You Provide

You retain ownership of the photos, profile information, biography, prompts, messages, and other content you submit ("Your Content").

By submitting Your Content, you grant Kindova a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to host, store, reproduce, process, display, transmit, and distribute Your Content solely for the purpose of operating, maintaining, improving, promoting, and providing the Service.

You represent and warrant that you own or possess all necessary rights to submit Your Content and that it does not violate the intellectual property, privacy, or other legal rights of any third party.

5. Verification Features

Kindova offers optional photo verification to improve user trust and reduce fake accounts. During verification, a live selfie is compared with your existing profile photo to confirm that both images depict the same person.

Photo verification is intended solely as a trust indicator. It is not a criminal background check, identity certification, or safety guarantee, and should not be relied upon as such.

Information relating to photo verification is processed in accordance with our Privacy Policy.

6. Subscriptions, Coins & Payments

Kindova offers optional premium subscriptions (including Gold and Platinum) and virtual Coin packs. All purchases are processed securely through the Apple App Store or Google Play. Kindova does not receive, process, or store your payment card, bank account, or billing credentials.

• Subscriptions automatically renew for the same billing period unless auto-renew is turned off at least 24 hours before the current subscription period ends.
• Your Apple ID or Google Play account may be charged for renewal within 24 hours before the end of the current subscription period.
• You may manage, upgrade, downgrade, or cancel your subscription through your Apple ID settings, Google Play account settings, or the Settings → Manage Subscription section of the Kindova app.
• Deleting your Kindova account does not automatically cancel your subscription.
• Any unused portion of a free trial, promotional period, or introductory offer will be forfeited once you purchase a paid subscription, where permitted by applicable law.
• Refund requests are handled exclusively by Apple or Google under their respective refund policies. Kindova cannot approve, deny, or issue refunds for purchases made through those platforms.
• Coins are virtual items intended solely for use within the Service. Coins have no cash value, cannot be redeemed for money, transferred between users, sold, or exchanged outside the Service.
• Unused Coins are forfeited upon account deletion or termination unless otherwise required by applicable law.
• Kindova reserves the right to modify subscription features, Coin pricing, promotional offers, or premium benefits at any time. Material changes will not affect an active subscription period already purchased unless required by law.

7. Referral Program

Kindova may offer referral programs, invite codes, promotional campaigns, and bonus Coins from time to time. Participation is voluntary and subject to these Terms.

Referral rewards are granted at Kindova's sole discretion and may be changed, suspended, limited, or discontinued at any time without prior notice.

We reserve the right to withhold, reverse, or remove referral rewards obtained through fraudulent activity, fake accounts, self-referrals, automated systems, multiple accounts controlled by the same individual, or any abuse of the referral program. Accounts involved in referral fraud may be suspended or permanently terminated.

8. No Background Checks & Assumption of Risk

While we use automated moderation tools, optional photo verification, reporting systems, and other safety measures, we do not guarantee the identity, honesty, intentions, or conduct of any user.

You are solely responsible for your interactions with other users, both online and offline. Before meeting another person in real life, you should exercise caution, use good judgment, and follow appropriate personal safety practices.

Your use of the Service and any meetings or communications arranged through Kindova are entirely at your own risk.

9. Suspension & Termination

You may delete your account at any time through Settings → Delete Account.

Kindova may suspend, restrict, or permanently terminate your account, with or without prior notice, if we reasonably believe you have violated these Terms, our Community Guidelines, applicable law, or if such action is necessary to protect other users, investigate fraud, maintain the integrity of the Service, or comply with legal obligations.

Account termination does not relieve you of obligations incurred before termination. Provisions relating to intellectual property, limitation of liability, indemnification, dispute resolution, and any other provisions intended by their nature to survive termination shall remain in effect.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS TO THE FULLEST EXTENT PERMITTED BY LAW.

KINDOVA DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AND AVAILABILITY.

We do not guarantee uninterrupted access, continuous availability, successful matches, compatibility with every device, or that user-generated content will always be accurate, lawful, complete, or truthful.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KINDOVA, ITS DIRECTORS, OFFICERS, EMPLOYEES, SHAREHOLDERS, AFFILIATES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, BUSINESS OPPORTUNITIES, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR YOUR INTERACTIONS WITH OTHER USERS, INCLUDING OFFLINE MEETINGS.

Some jurisdictions do not permit certain exclusions or limitations of liability. In those jurisdictions, our liability shall be limited to the fullest extent permitted by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless Kindova, its directors, officers, employees, affiliates, contractors, licensors, and partners from and against any claims, liabilities, damages, losses, judgments, costs, and reasonable legal fees arising out of or related to:

• Your violation of these Terms;
• Your use or misuse of the Service;
• Your content or communications;
• Your interactions with other users;
• Your violation of any law or third-party rights.

13. Governing Law & Dispute Resolution

These Terms, and any dispute arising out of or relating to them or the Service, are governed by and construed in accordance with the laws of the Islamic Republic of Pakistan, without regard to its conflict-of-law principles.

Subject to any mandatory consumer-protection rights you may have under the law of your country of residence that cannot be waived by agreement, you agree that the courts of Pakistan shall have exclusive jurisdiction to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Service.

Before filing a formal claim, we encourage you to contact us at legal@kindovatech.com so we can try to resolve the matter informally.

14. Copyright Complaints

Kindova respects the intellectual property rights of others and expects users of the Service to do the same. If you believe that content on the Service infringes your copyright, please send a written notice to legal@kindovatech.com that includes:

• A description of the copyrighted work you believe has been infringed;
• The location (e.g. profile, message, or URL) of the material you believe is infringing;
• Your name, address, telephone number, and email address;
• A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf;
• Your physical or electronic signature.

Upon receiving a valid notice, we may remove or disable access to the reported material and, in appropriate cases, suspend or terminate the accounts of repeat infringers.

15. Changes to These Terms

We may update these Terms from time to time to reflect changes in our Service, technology, legal requirements, or business practices.

If we make material changes, we will provide reasonable notice through the app, our website, or by email before the updated Terms become effective.

Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance of the updated Terms. If you do not agree with the revised Terms, you must stop using the Service and delete your account.

16. Intellectual Property

Except for content that you submit, all rights, title, and interest in and to the Kindova Service, including its software, source code, algorithms, databases, trademarks, logos, graphics, text, designs, user interface, and other intellectual property, are owned by or licensed to Kindova and are protected by applicable intellectual property laws.

Subject to these Terms, Kindova grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for your personal, non-commercial use.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, decompile, create derivative works from, or otherwise exploit any part of the Service unless expressly authorized by Kindova in writing.

17. Force Majeure

Kindova shall not be liable for any delay, interruption, or failure to perform any obligation under these Terms where such delay or failure results from circumstances beyond our reasonable control.

These circumstances may include natural disasters, earthquakes, floods, fires, epidemics, pandemics, war, terrorism, civil unrest, government actions, labor disputes, internet or telecommunications failures, cyberattacks, power outages, failures of third-party service providers, or any other event beyond our reasonable control.

18. Severability

If any provision of these Terms is held to be unlawful, invalid, or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permitted by law, and the remaining provisions shall remain valid, enforceable, and in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Community Guidelines, and any additional policies or legal notices published by Kindova, constitute the entire agreement between you and Kindova regarding your access to and use of the Service.

These Terms supersede all prior or contemporaneous agreements, communications, and understandings relating to the Service, whether written or oral.

Our failure to enforce any provision of these Terms shall not be considered a waiver of that provision or any other right.
